Acquisition of title is a form of ownership used by those who act as the owner of said property without actually being the owner, in a public, peaceful, and uninterrupted manner for a minimum period of fifteen (15) years.

In obligations acquired where a penalty clause is agreed upon, the law establishes that it is a right to demand it in the event of noncompliance by one of the parties; the debtor may not claim non-performance of the agreement by arguing that it has not caused any harm to the creditor.

A commodate should not be confused with a lease agreement, since in a loan for loan, the lender retains ownership of the loaned item and the borrower retains use of it, but not the fruits. The loan is returned upon fulfillment of the term or condition agreed upon by both parties.

In civil matters, evidence is the means that support the parties’ claims and are presented with the complaint or during the evidentiary period. This evidence may include documents, testimony, statements from parties, witness statements, judicial inspections, reports, and expert opinions, all of which should lead us to certainty about the facts.

Jurisdiction is determined in different ways: by territorial reasons; by the nature of the matter; by the status of the parties; and by the amount. For example, before Municipal Civil Courts, the amount ranges from US$1,001.00 to US$5,000.00, and before Circuit Civil Courts, the amount ranges from US$5,001.00 and up.

If the adverse ruling comes from a municipal judge, you can appeal the ruling to your superior, the circuit judge. If the adverse ruling comes from a circuit judge, you can appeal to the Superior Court. If you disagree with the results before this court, you can file an extraordinary appeal for cassation, after first studying the grounds for cassation.
